§ 10.9.2. Procedure and conditions for approval of seasonal parking

  • Seasonal parking as defined in section 10.9.1 may be permitted by a special exception permit in any zoning district on parcels of property no less than one acre in size and within one mile of the outer limits of the property it is intended to serve. An application for a special exception permit shall be submitted to the planning and community renewal division, accompanied with the appropriate fee and a site plan showing the proposed improvements. In reviewing applications for such special exception permits the planning commission shall consider the following:

    a. Ingress and egress to the parking area is available from a major or urban thoroughfare as defined in the master thoroughfare plan. No access to the parking lot shall be provided from a residential street.

    b. All seasonal parking areas shall be provided with adequate lighting unless such areas are to be utilized only during daylight hours. In accordance to article IX, section 9.6.6, all lighting shall be so installed that the surface of the source of light shall not be visible from any bedroom window, and shall be so arranged as far as practical to reflect light away from any residential use; and in no case, except municipal street lighting, shall be more than one foot candle power of light across a lot line five feet above the ground in a residential district.

    c. All parking areas shall be required to provide paving or some other acceptable surface material to control dust, such as seal coat, slurry seal, stone, concrete paver or other materials as approved by the city engineering division. Section 10.6 shall not apply to seasonal parking areas.

    d. When the area is not open for use all entrances and exits shall be closed off by a chain or other adequate means to prevent vehicular access to the area.

    e. When a seasonal parking area abuts a residential district, a wall, fence, landscape buffer, or other screening device acceptable to the planning commission shall be provided to protect adjoining residential properties. The planning commission shall give due consideration to factors unique to the location and orientation in determining the type of screening required.

    f. All refuse, litter, and debris shall be removed from seasonal parking areas within one day after each use thereof.

    g. Fire extinguishers shall be provided at locations as determined by the Fire Department.

    h. Clearly visible signs shall be placed at each entrance which shall indicate the parking fee in figures no larger than six inches in height.

    i. All seasonal parking areas shall be required to provide wheel stops not in excess of two feet in height to protect nearby residential properties from trespass or encroachment of motorized vehicles.

    j. The planning commission may require other physical improvements to the site and may impose conditions an the approval of a special exception permit as deemed necessary.
